Roost Terms of Use

These terms govern your use of the Roost application for macOS (“Roost” or the “app”) and the website at https://roost.afceda.com. Roost is developed and published by an independent developer (“we”, “us”). By installing or using Roost you agree to these terms. If you obtained Roost from the Mac App Store, Apple’s Licensed Application End User License Agreement also applies; where the two conflict, Apple’s agreement prevails for that copy.
1. License
Roost is proprietary software. Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use Roost on Macs that you own or control, for your own purposes, including commercial work you do on those Macs. All rights not expressly granted remain with us. Roost, the Roost name and logo are our property.
You may not copy (other than for backup), modify, reverse engineer, decompile or disassemble Roost except to the extent applicable law expressly permits; rent, lease, lend, sell, redistribute or sublicense it; remove or alter any proprietary notices; or use it to build a competing product by extracting its logic or assets. Where source code is made available for viewing, viewing does not grant any of these rights.
2. What Roost does and what you are responsible for
Roost runs a local server on your Mac and routes requests from your applications either to Apple Intelligence on your Mac or to third-party AI providers that you configure. You are responsible for:
- the providers you add, the accounts and API keys you use with them, and any charges they bill you;
- complying with each provider’s terms, including limits on the content you may submit;
- the content of the requests your applications send through Roost and what you do with the answers;
- the network setting you choose: if you open the server to your local network, anyone on that network can use your providers through Roost, and that is your decision and your responsibility;
- keeping your Mac, its accounts and your keys secure.
3. Third-party services
Cloud providers, local model servers and the applications you connect to Roost are not ours. We do not control their availability, output, pricing or data handling, and we are not a party to your agreements with them. References to third-party products in the app or on the website are for compatibility information only and do not imply endorsement or affiliation. Apple, macOS and Apple Intelligence are trademarks of Apple Inc.; Roost is an independent product.
4. AI output and the privacy assessment
Answers produced through Roost are generated by language models, on your Mac or at a provider. They can be wrong, incomplete, outdated or inappropriate, and you should not rely on them for decisions with legal, medical, financial or safety consequences without independent verification.
In the Smart and Private modes the decision to keep a request on your Mac is made by a language model following instructions you can read and change in the app. This assessment is a best-effort classification, not a guarantee. It may fail to recognize private data or may classify harmless requests as private. You can see every decision in the app; if a request must never leave your Mac, use the On-device mode. We are not liable for data sent to a provider as a result of a routing decision, an unavailable provider, a setting you changed or a mistake in the assessment.
5. Acceptable use
You may not use Roost to violate any law, to infringe the rights of others, to send content to providers in breach of their terms, to gain unauthorized access to systems or to interfere with the operation of the app or the website.
6. Updates and changes to the app
We may release updates that add, change or remove features. Updates obtained through the Mac App Store are delivered under Apple’s terms. We may discontinue Roost or any of its features at any time; we will try to give reasonable notice for material changes through the app’s release notes or the website.
7. Price
Roost is currently offered free of charge. If we introduce paid features or a paid version in the future, the price and what it covers will be stated in the Mac App Store or on the website before you pay, and payments made through the App Store are handled under Apple’s terms.
8. Privacy
How Roost handles data is described in the Privacy Policy at https://roost.afceda.com/privacy, which forms part of these terms.
9. Disclaimer of warranties
Roost is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that Roost will be uninterrupted, error-free or compatible with any particular application, model or provider. Some jurisdictions do not allow the exclusion of implied warranties; in that case the exclusion applies to the extent permitted.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, business or goodwill, arising out of or related to Roost, the answers produced through it, the routing of requests or any third-party service, even if we were advised of the possibility. Our total liability for all claims relating to Roost is limited to the amount you paid us for it in the twelve months before the claim, or, if you paid nothing, to ten US dollars. Nothing in these terms limits liability that cannot be limited under applicable law, including for death or personal injury caused by negligence or for fraud.
11. Governing law and disputes
These terms are governed by the law that applies to you under the mandatory rules of the country where you live, and disputes will be brought before the courts competent under that law. If you are a consumer, nothing in these terms deprives you of the protection of the mandatory consumer laws of your country. For copies obtained from the Mac App Store, Apple’s Licensed Application End User License Agreement sets the governing law for the license itself.
12. Termination
You may stop using Roost at any time by deleting it. Your license ends automatically if you breach these terms. Sections 3, 4, 9, 10 and 11 survive termination.
13. Changes to these terms
We may update these terms; the effective date shows the current version. Material changes will be announced in the app’s release notes or on the website. Continued use of Roost after a change means you accept the updated terms.
14. Apple-specific terms
For copies obtained from the Mac App Store: these terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for Roost. Apple is not responsible for addressing any claims relating to Roost or your use of it, including product liability claims, claims that Roost fails to conform to legal or regulatory requirements, consumer protection claims and intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You represent that you are not located in a country subject to a US government embargo or designated as a terrorist-supporting country, and that you are not on any US government list of prohibited or restricted parties.
